1. Introduction and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "User") and Adit Goel, operating as EduNova Studio, for the use of this website and all services offered herein.
By accessing this website, placing an order, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.
Governing Law: These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, Information Technology Act, 2000, and the Consumer Protection Act, 2019.
2. Services Offered
EduNova Studio offers the following digital and educational services:
- Presentation Design (PowerPoint / Canva)
- PDF Editing (formatting, conversion, merging, content editing)
- Copy Typing (handwritten/printed to digital text)
- Data Entry and Spreadsheet Services
- Web Development (HTML/CSS/JS websites)
- Digital Business Card Design
- Teaching / Tutoring Services
All services are provided by Adit Goel on a freelance basis. Service availability is subject to capacity and mutual agreement.
3. Order Process and Agreement
3.1 How to Place an Order
Orders can be placed via WhatsApp (+91 89305 98651), Email (edunova1125@gmail.com), Instagram DM (@edu_nova25), or through the contact/order forms on this website.
3.2 Order Confirmation
An order is confirmed only when we acknowledge acceptance in writing (via WhatsApp or email). Submission of an enquiry or form does not constitute a binding order.
3.3 Requirements
The Client is responsible for providing accurate, complete, and timely materials required for service delivery. Delays caused by late or incomplete client materials do not obligate us to extend deadlines without additional agreement.
4. Pricing and Payment
4.1 Pricing
Service prices are as displayed on the website and are subject to change. Quoted prices are valid for 7 days from the date of quotation.
4.2 Payment
Payment is accepted via UPI, bank transfer, or other mutually agreed digital payment methods. Payment terms (advance/full) are agreed before each project begins.
4.3 Taxes
All prices are inclusive of applicable charges. GST (Goods and Services Tax) applicability will be disclosed where required by Indian tax law.
Note: EduNova Studio currently operates below the GST registration threshold. If our turnover exceeds the prescribed limit under the CGST Act, 2017, GST will be charged and disclosed accordingly.
5. Intellectual Property Rights
Under the Copyright Act, 1957 (India):
- All original content, designs and code created by EduNova Studio remains our intellectual property until full payment is received.
- Upon full payment, the deliverable and all associated rights transfer to the Client for their personal/commercial use as agreed.
- EduNova Studio retains the right to display completed work in its portfolio, unless the Client explicitly requests confidentiality in writing.
- The Client warrants that any materials provided to us (text, images, logos) do not infringe any third-party intellectual property rights.
- EduNova Studio is not liable for any IP infringement claims arising from Client-provided materials.
6. User Conduct and Prohibited Uses
You agree not to:
- Use our services for any unlawful, fraudulent, or malicious purpose
- Submit content that is defamatory, obscene, or violates any applicable Indian law
- Attempt to gain unauthorised access to our systems or Firebase database
- Post false, misleading or spam reviews on our website
- Use our deliverables in a manner that violates third-party rights or applicable laws
- Copy or reproduce our website content without written permission
Violation of these conditions may result in cancellation of services without refund and, where applicable, legal action under the IT Act, 2000 and IPC provisions.
7. Limitation of Liability
To the maximum extent permitted by Indian law:
- EduNova Studio's total liability for any claim shall not exceed the amount paid by the Client for the specific service in question.
- We are not liable for indirect, incidental, consequential, or punitive damages.
- We are not responsible for outcomes resulting from the use of our deliverables in the Client's context.
- We are not liable for delays caused by circumstances beyond our reasonable control (force majeure).
This limitation does not apply to liability arising from fraud, willful misconduct, or personal injury caused by negligence, which cannot be excluded under Indian law.
8. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms:
- Step 1 โ Negotiation: Both parties will attempt to resolve the dispute amicably within 30 days of written notice.
- Step 2 โ Consumer Forum: Consumers may approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
- Step 3 โ Arbitration: Unresolved commercial disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.
Jurisdiction: Courts in Haryana, India shall have exclusive jurisdiction over any disputes not resolved through the above mechanisms.
9. Termination
Either party may terminate a service agreement by providing written notice (via WhatsApp or email). In case of termination:
- Work completed up to the point of termination will be billed proportionally.
- Advance payments for incomplete work will be refunded as per our Refund Policy.
- We reserve the right to terminate immediately in cases of Client misconduct or breach of these Terms.
10. Amendments to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this website with an updated date. Continued use of our services constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.
